Hi everybody, As today is the last scheduled day that the US Supreme Court will reportedly issue decisions on pending cases, it's widely expected that an announcement will be made regarding the Prop 8 case. This thread has been created for any discussions regarding the case and any decision that is made by the court. http://www.scotusblog.com/ Live blogging will begin from SCOTUS blog from 9am EST. I'm not sure what that translates to in other timezones, but for my fellow Brits that is 2pm. Re: Prop 8: Supreme Court Ruling Slight chance they could have a broad ruling on this when/if they strike it down. That would make same sex marriage legal in all 50 states. *fingers crossed*
Re: Prop 8: Supreme Court Ruling i think itll be more likely for them to strike down prop 8 rather than make it legal in all the states. but remember, they wouldnt take all of DOMA down, it would just be part 3, meaning if you can already legally get married in a state then you can get the federal benefits as well as the state ones
Re: Prop 8: Supreme Court Ruling This is a really tricky case. They could issue a broad ruling - banning same-sex marriage in every state. They could issue a specific ruling - upholding the ban in question. They could issue a specific ruling - striking down the ban. They could issue a broad ruling - making it illegal for a state to ban same-sex marriage. Among a lot of other outcomes. And, I thought it was weird the SCOTUS thread got closed.
Re: Prop 8: Supreme Court Ruling That's just to assist in keeping the conversation structured and on track. If, for example, they strike down DOMA and uphold Prop 8 then you'll have a minimum of two conversations/reactions going on at one time. By separating the two topics into their respective cases it will hopefully allow for things to flow more smoothly.

Perry." Amy Howe: To be clear, the Court has not yet released the decision in Prop 8, but there is language in Windsor telegraphing that the Court will dismiss on standing.
Re: Prop 8: Supreme Court Ruling It ticks me off that there's no live audio for the Supremes. The argument that they worry about it being televised do to the potential for people to make highly politicized statements due to the nature of it being live television makes sense...I see no such proper reasoning for live audio, provided it's not televised. Anyways... looks like they're pointing toward dismissing it on standing. Again as was speculated. It means, in the most plain of English, that they are going to claim they shouldn't have taken the case in the first place, and just left it at the District Court level. So the District Court ruling will stand, and California will have marriage equality - but no broad ruling (for the entire US) for or against marriage equality will come from this case. In the future, there may be another case brought forth where they could give a ruling...likely for marriage equality. But they have to take it and decide to rule on it first. "Justice Scalia's bench statement is lengthy..." When isn't it? :lol: It's what he exists for, after all. XD
Re: Prop 8: Supreme Court Ruling I BELIEVE Dismissing on Standing means that they dismiss the case as the people appealing didn't have... standing. Which, unless I'm mistaken, would uphold the original overturn by the California Judge. Keep in mind, no official ruling has been made.
