Cop out but better than upholding Prop 8.

But DOMA being declared unconstitutional and Prop 8 being shot down, even if not in a wide ruling, is still a massive step forward. And gives plenty of precedence for the future.

Here's hoping the Prop 8 ruling ends up good.

Correct. Although as Tim said, striking down DOMA gives all same-sex couples in states where there is marriage equality the FULL federal benefits of such a marriage license. So it is indeed a huge step forward.

I never liked our supreme court and never will unless they actually come to there senses. I dont like some of the decisions they have made in the past years except this one WHICH is great but

This isn't a hard decision....the only thing holding them back is extreme religious people protesting and sticking to the "word of god".

    EDIT: still

Kennedy can't back out of voting to shoot down Prop 8 now. We need these votes to hold.

Re: Prop 8: Supreme Court Ruling

Well whatever the ruling on Prop 8 is, at least we now know the Supremes unanimously agree that "attempting to compel a person to recommend that his employer approve an investment does not constitute the obtaining of property from another under the Hobbs Act."

    So we have that.

We have Perry. By the Chief. The petitioners did not have standing to appeal the district court order.

    Amy Howe:
From the opinion: We have never before upheld the standing of a private party to defend the constitutionality of a state statute when state officials have chosen not to. We decline to do so for the first time here.

    ---------- Post added 26th Jun 2013 at 09:28 AM ----------

    Amy Howe:
The Ninth Circuit was without jurisdiciton to consider the appeal. The judgment of the Ninth Circuit is vacated, and the case is remanded with instructions to dismiss the appeal for lack of jurisdiction.

Re: Prop 8: Supreme Court Ruling

Sounds like they're saying the private party that filed the appeal had no right to do so, and is upholding the judge's initial repeal?

Re: Prop 8: Supreme Court Ruling

They appear to be affirming the Ninth Circuit's decision to strike down Prop 8?

(albeit not necessarily ruling on the case)
