Court in India criminalizes homosexuality - The Washington Post India decriminalized homosexual acts in a 2009 court decision, but the law remained on the books. The Supreme Court just overturned that decision, putting the law back into force. As it stands now, the police may arrest and prosecute individuals for homosexual acts.
I don't think it can be put into words just how monumentally stupid that Indian court looks right about now.
Okay that definitely sucks considering India is one of the better (comparatively speaking) working democracies in Southeast Asia. What the heck happened? This thread made me have a minor heart attack at first because I definitely thought the article said "Indiana Supreme Court" for a split-second.
"I've said it before, and I'll say it again: Democracy simply doesn't work." Really, this is why we have a Bill of Rights in our own constitution: to keep the majority from removing basic human rights and dignity from the minority.
I don't give a toss about your constitution (no offence). It doesn't mean f all if it cannot be enforced.
sad sad sad day for LGBT in India I'm an Indian and i feel ashamed by the supreme court's verdict. Indian supreme court set aside (or literally rejected) the 2009 verdict from Delhi high court (lower court) to decriminalize homosexuality. This is grave step back to medieval times! This centuries old barbarian law (section 377) imposed by colonial British is still intact! The Section 377 (a law) criminalizes sexual activity "against the order of nature." The section was read down to decriminalize same-sex behavior among consenting adults in a historic judgement by the High Court of Delhi on 2 July 2009. We expected the Supreme court to use their prudence to set precedent for the parliament to eventually amend the law. But the court says that Section 377 should be a matter left to Parliament, not the Judiciary. Its a sad sad day for civil liberties in India :icon_sad:
Yes that was insensitive really! Sanitation is still an issue. But don't generalize, because india is a developing country with a lot of problems, with rich and the poor. At the same time India has its goals both scientific and social/civil goals in sight. ---------- Post added 11th Dec 2013 at 11:51 AM ---------- Yes, i'm an Indian, and its depressing really. The only way forward is for our politicians to amend that barbaric law through debate in parliament. I don't see that happening in the near future, because politicians in india are very conservative and represent a deeply religious sect of people... It's hard to comprehend a debate of this nature in the parliament :eusa_doh:
Re: sad sad sad day for LGBT in India ^Do you think the Indian parliament will have the guts to deal with this? It happens here in Canada too, where spineless politicians leave it to the Supreme Court to judge on matters that would more appropriately be debated and voted for in parliament. I suspect that the problem is that there is that there may not be a constitutional Charter of Rights and Freedoms (as we have in Canada) which the Indian Supreme Court can use as a peg to hang their judgments on...
Re: sad sad sad day for LGBT in India I know, I heard about this. I'd feel ashamed of my country for its part in this, except that I already hate its guts.
Hmm, I agree with most of everything you said above, but space exploration doesn't necessarily mean that a nation is ignoring it's social issues. That being said, I do think it's sad that agencies such as NASA and it's foreign counterparts wouldn't exist if it weren't for military application/international posturing. All to often the "drive" behind these types of missions don't seem to be entirely science based, in my opinion.
Haha, I did too. Anyway, news like this is always so depressing. I hope this decision will be appealed.
a shame, really. Its one thing to not like homo, but to criminalize it after decriminalizing it 4 years ago shows how homophobic some are in Indiana.
