Question on Legal Rights Regarding GSA's

    Our school board has just denied our GSA and refused to authorize it. They say they don't like the name (which is just GSA) because they fear it would lead to repercussions from the community. Which by the way is extremely conservative. I can understand why they would be a little nervous but I think they may be infringing on our rights but to be honest I am not sure. So is this infringing on our rights as students or are they on the right side of the law?

    They denied you because they don't like your name? Nope, they can't do that. You need to start making some phone calls right away. Contact PFLAG and GLSEN/ Get some people to back you up in your area and approach them again. If they have no other valid excuse, then contact the ACLU.

    Unless of course you are in a private school. The laws apply differently there. Contact the ACLU!

    This club has to be allowed if this is a public school. Fight for it.
     
  5. It is infringing on your rights. If it's a public school then they have to abide by the Federal Equal Access Act. Tell your school that according to this law, they have to allow your GSA or not allow any clubs of any sort at all.

    Yup. Exactly. That FEDERAL law states that if there is any after-school club in the school, and a GSA is requested, then the GSA must be allowed to have equal club-status. If not, the public school will lose every drop of public spending. :slight_smile:
