This is pure gossip. I served with plenty of gay and lesbian soldiers under don’t ask don’t tell. Being gay in the army at that time was not punishable by jail time. Admittance got you an honorable discharge. I know because I received an honorable discharge for homosexual conduct. And most joes didn’t care if you were gay straight or otherwise as long as you did your job.

However your other points are valid giving up a career, being a grunt to serve. But I can not get behind murder on this one. I was over there. And lots of miserable stuff happened to a lot of good people.

 

UCMJ:

925. ARTICLE 125. SODOMY
10. Punitive Articles

(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration , however slight, is sufficient to complete the offense.

(b) Any person found guilty of sodomy shall be punished as a court-martial may direct.

As you know, a court-martial almost always includes jail time.

So yes, having gay sex was punishable by jail time. They just chose not to do that for whatever reason in your case I guess. You also seem to have gotten lucky with an honorable discharge, because I know of two people where I'm from who were removed from the Air Force for being gay with an other than honorable discharge back then (large air base, they stayed in the town anyway and people got to know them years later after their relationship was discovered and they were removed).

 

Ok so if you read further into the UCMJ that you so nicely quoted, you will also see a subsection that states if the service member admitted to the conduct and negate the courts martail, it is subject to a chapter 14 and honorable discharge under general conditions.

Where this applies is when someone denied committing homosexual conduct and takes it to court martial then is found guilty of the charges. Most cases like this result in a Bad Conduct Discharge and no time. In cases of forced sodomy then jail time would Be iminate not only by the military courts but by the civilian courts if a report had been filed off post.

 

Also should mention time plays a factor as to when those discharges happened, if it happened before 1996 it was not an option to get an honorable discharge.
