    Appeals court rejects Utah’s request for emergency stay on marriage ruling – LGBTQ Nation

    Basically, same sex marriages and unions may continue, even during the state's motion starting Monday at 9 AM, which would make a lot of people angry if they do overturn the lower court's ruling, nullifying every marriage license.

    I noted the Republicans are seething over these 'activist judges' again...odd, had he ruled the other way, they'd be praising his sound jurisprudence.

    What a nice Christmas present!

    I'm curious as to how this will play out.

    I read about it and they didn't issue the emergency order because the trial judge hasn't yet ruled on a motion for him to issue a stay. Once that happens, the state officials can then appeal to the 10th Circuit. According to the LA Times

    Basically, tomorrow Monday, the trial judge, Judge Shelby, will have a meeting to consider he staying his own order until it gets heard by the 10th Circuit. If he grants the stay, then the marriages stop until/if the 10th Circuit issues a ruling (or even then, it could re-stay it's order again if it gets appealed to SCOTUS, like the Prop 8 case where, even though the trial judge and the 9th Circuit affirmed "gay marriage," they stayed their order pending SCOTUS and no same-sex marriages occurred during the whole appeals process.

    If Judge Shelby doesn't stay his order, then Utah can ask for the 10th Circuit to issue a stay pending their review of the case.

    I'll have more hope if the 10th Circuit doesn't issue a stay based on the merits and not technicalities of the case.

    Judge Allows Same-Sex Weddings to Continue in Utah

    The District Court Judge refused to grant a stay, allowing marriages to continue until the 10th Circuit weighs in, or issues a stay.

    Thus, there's going to be a lot of gay marriages in Utah the nest several days!

    i think this is how it should always happen, gay marriage is a right, we shouldnt have to convince voters to aprove anyones love!

    ...and the 10th Circuit rejects their motion for a stay yet again!

    Looks like they're going to appeal it to the Supreme Court later this week requesting an emergency stay, which would be dealt with by Justice Sotomayor. Should be interesting.

    Now this is pretty exciting. This was made on the merits of the appeal and not the technicalities so that's a good sign. I'm glad the case will be expedited. It's interesting that if the 10th Circuit rules in favor of gay marriage in this case, and SCOTUS doesn't take the appeal, the ruling of the 10th Circuit would be set a precedent in all of the states in the 10th Circuit; THAT would be interesting.

    Reading the latest order by the 10th Circuit denying the emergency stay is interesting. It almost seems as if the two judges who reviewed the emergency order (an Obama and a G. W. Bush appointee) are saying that the case by Utah is probably flimsy and/or there's no irreparable harm in letting the marriages continues, pending resolution of the case.

    This has been amazing to watch unfold, and watching the Republicans scramble around like crazy...especially during the holidays.

    One would think that if the Republicans were savvy, they'd give up this stupid anti-gay rights fight, in order to preserve their party as the older members die off, and younger people refuse to go along with their bigoted antics. Because I think they're going to lose the fight, and sooner than later.

    It always amazes me, the trouble certain people will go to in order to try to oppress others, based on crusty old myths in a fictitious book, or whatever other crotchet.

    I can't see one of the more liberal justices in Roberts Court behind only Ruth Bader Ginsburg accepting an emergency stay. Should be interesting, like you said, though.

    republican politics is rooted in fear, and the climate where they can use the fear of 'gay' to scare people is fast depleting. They use the same tactics with women: if women are allowed to make their own healthcare desicions about cancer screenings, birth control, etc, then it means the destructive of society, because we need lots of babies, and women should have to pay more because they have boobies (I am not making any of this up; a republican was defended by his collegques for saying women should have to pay more because according to him, men don't have breasts, which is wrong, they do, they just don't usually have the hormonal signatures required for the breast to develop).

    They also created the war on christmas, which is actually a republican war on the 1st ammendment; the entire war on christmas is an attack on the rights of others to be of different faiths. Since the holocaust meant that the conservative and fundementalist movement can't risk being openly anti-semetic anymore, they use the war on christmas as one of their ways of attacking jewish and other faiths. they don't even support the jewish population in isreal; the right wing politicians who profess support for isreal are also obsessed with end-times prophecy, and support and defent anti-semetic preachers. They support isreal because they want to tear down the dome on the rock and rebuild the jewish temple so christ can come, because they delude themselves into thinking christ agrees with them.

    by saying that wishing a person a 'happy holiday' because you respect people of all faith is an attack on christanity, they are demeaning and mocking the rights granted by the founding fathers for people of all faith to practice their beliefs in america. they are demeaning any faith that doesn't fit with their false, anti-christian interpretation of a bible that rejects the republican/conservative ideals outright as hell-worthy sin.

    Republicans are not savvy; they got away with it for so long that now that people are becoming more sophisticated, and the party continues to cling to their old ways, america and the world is leaving them behind. They are not savvy; they are stubborn.

    I love this quote, "According to the order, the state failed to demonstrate it was suffering “irreparable harm” as a result of the legalization of same-sex marriage and also failed to show it had a “significant likelihood” of prevailing in its appeal to the circuit court." :thumbsup:

    That would certainly be interesting. The 10th Circuit includes liberal New Mexico (already a marriage equality state) and liberal Colorado (where a majority already support marriage equality)...but it also includes ultra-conservative Wyoming, Kansas, and Oklahoma (!). Utah and Oklahoma are probably the two most socially conservative states in the USA, we're already winning equality in Utah (Utah does have some liberal areas, namely Salt Lake City and ski resort areas), but this episode could lead to strange things happening in the most conservative state in the union. (Oklahoma is the only state in the USA where Barack Obama never won a single county. In fact it's the only state where Democrats haven't won a single county in a presidential election since 2000. It also passed it's anti-gay marriage ban with 76% overall and over 70% in every single county).

    Oklahoma has had a marriage equality case that judges have failed to even look at for 9 years. This would be huge if it sets precedent for the 10th district.

    Same-sex Couples Shatter Marriage Records In Utah

    As someone who grew up in Oklahoma and now lives in Salt Lake City, I'm very excited about this. I like to think that if something "progressive" happens in Oklahoma or other conservative states, you know pretty well that the country as a whole will shift in that direction.
