First Australian state to legalise same-sex marriage

    Oh great! I've always loved to come to Australia and it's about time they legalized gay marriage anyway! I hope they'll do it soon!

    Are the states as divided in Australia as they are in America? Good news nonetheless.

    The states aren't so divided, polls have consistently put support at over 60%. The problem in Australia is that under our Constitution the federal parliaments has the power to legislate with respect to marriage. While the states also have the power to do that, our constitutions also says that where there is a federal law and a state law on the same subject matter the federal legislation prevails to the extent of the inconsistency. The federal marriage act defines marriage as between one man and one woman, hence the legal problem.

    Let's hope the equality wave will flow further and move into the rest of Australia.

    It's not really a race, considering you guys have already won. You have a Prime Minister from a centre-right party who supports it. Our Prime Minister, leader of a so-called socially progressive party, does not support it. It's so improbable it's almost humorous.

    I know, it is very strange. Gillard is very weird.

    We haven't legalised it yet, though! And the Prime Minister doesn't have any more power in this matter than any other MP, so it's not completely assured.
