    In 2008 same sex marriage was made legal and then six months later the constitution was amended to make marriage only valid between one man and one woman. The same sex marriages that were performed during those six months were still legal. By common law you cannot invalidate something that has already happened by passing a law against it and USA law is based in common law.

    I assume you're talking about California as there hasn't been any such amendment nationally. I don't live in California, although I was married there. In Illinois marriage equality was legislated before any court intervention so I'm not really worried about it being invalidated, but I am worried about federal recognition. The justification given for overturning Obergefell was one of free exercise and the statements were made in reference to the Kim Davis case which certainly does make me wonder within what circumstances and positions of power are people going to be allowed to decide they don't believe in my marriage?

    Yes, California, sorry I thought that I had specified that, guess I am a bit tired. The 2015 decision was due to lawsuits against the California amendment and same sex marriage was illegal in California until that decision.

    If the court reverses the decision then it will probably go back to the patchwork that it was before. Your marriage will be legally recognized where they accept same sex marriage and ignored where they don't. I doubt that same sex marriage would stop in California or many states but I am also certain that in many others (pretty much all of the ones where women's autonomy rights are also being lost) it will end.

    I said it before, I'm saying it now.
    We need to amend the Civil Rights Act, or campaign for a new one. Not like it hasn't been done before.

    Protected marriage equality.
    Demilitarizing of police and redistributing police work, at the very least.
    Protected women's rights including the choice for abortion.
    Legal recognition of gender and bathroom nondiscrimination without a million hoops.
    Healthcare equity.

    These are all, ALL human rights issues that should be covered by past amendments!

    If there is anything to take away from the last 2 years, it is that they will still find a way to invalidate the marriages. Overall this whole thing is about Roe v Wade, but overturning Obergefelle v Hodges is still most definitely one of the things they'd been talking about recently. Over and over, they have framed marriage equality as an attack on Christianity and therefore religious freedom. They will use this as the basis for saying that since 2015 is invalid, therefore so is every same sex marriage made since.

    And now Trump is packing the courts while pointing the finger at the Democrats. Meanwhile, we can't even trust the courts to even bring justice to those who murder us for something we never chose. There are so, so many issues and so many lives that even aren't ours that will be affected by this whole deal. And it's all in the name of money for those in Washington, and "keeping America a Christian nation", however arbitrarily that's defined.

    Invalidating marriages that have happened would not be the same as making abortion illegal again, it would be like arresting and prosecuting everyone who has had one since 1974. If it does happen then the constitution and common law are essentially toilet paper. The country will go the way of The Handmaids Tale - Atwood or If This Goes On - Heinlein.

    From what I can tell, we're already at that point.
    This administration made the president immune to impeachments. I think that's the most clear-cut case for anybody to realize that there are no depths or levels they won't go to.

    The only reason I can think they won't arrest people for being gay or having arrests for people who got married to the same sex, is that this isn't the only issue to Christian Conservative Americaâ„¢, and they want to tick all the boxes in time. I seriously hope you're right, but with the GOP putting in their candidate for the SCOTUS after actively denying Merrick Garland the seat that Brett Kavanaugh now fills, I do not see much hope that's not legislation-based.

    @Hypernova @Old Dog All of the Nordic countries are always at the top of the list of happiest nations in the world. (that is west to east Iceland, Norway, Denmark, Sweden, Finland - Norway and Sweden have the languages which are easiest to learn for English speakers). In the past I had looked into others. One metric I liked to use was how their healthcare system works and when same sex marriage became legal. They are not perfect ways of selecting, but do indicate a bit about the nations attitude.

    Well if this makes it to SCOTUS again we need five justices to rule in favor of gay marriage. We have Sotomayor, Kagan, and Breyer in the bag. Then we need John Roberts and one of Gorsuch and Kavanaugh. Gorsuch is likely to rule our way, since he ruled that LGBT people are protected from getting fired. I don't know what Kavanaugh would do, but I think it's more likely he'd rule against it. Roberts ruled against it last time but he's deeply worried about keeping the integrity of the court and it's likely he won't rule to overturn a precedent set four years earlier (remember how he changed his ruling on the ACA at the last minute).
    All in all I'd say there's a 1 in 3 chance Obergefell will get overturned, which is sad and agitating because this should be a settled issue.
