BREAKING_DOMA_Section_Ruled_Unconstitutional Yay! From my understanding, this would allow married same-sex couples to collect on all social security and tax benefits from the federal goverment!
This is a bitter double-edged sword. While it makes it impossible to repeal gay marriage on the federal level...it makes it impossible to approve gay marriage on the federal level. This leaves the power to each states. This could mean decades for some states to approve gay marriage, especially those with constitutional bans.
forgive me, I dont really understand exactly how this makes it impossible to repeal it on a federal level? I was under the impression that this was striking specific things as unconstitutional here and now. it didnt say that the rest of it was constitutional. My impression was that this was a effort to break through the easiset to repeal aspects, and slowly erode away at the whole. Rather then try to force the entire issue, work to get concessions on what is pressing for the existing married couples. that way, we can show that by having equal benifits will not destory the econamy, as some conservative, non econamist politicians have tried to claim. then, we can systematically dismantle the rest as we garner more support.
According to Yahoo, this ruling makes the entire act unconstitutional. But then again, it's Yahoo. Notorious for getting things wrong.
thats fine by me if they want to get rid of doma cos its just wrong be my guest but it is wrong morally and ethically...:S where as love isnt wrong when its between two consenting people.
I hate to throw water on the celebration but I need to point out that this is just a district court ruling, it will at the very least have one appeal and possible more. This ruling really doesn’t mean anything.
Huge, awesome news! However, as I understand it it sounds like this only applies to Massachusetts couples. The federal government now has to decide whether or not to appeal. If they do, then it goes the First Circuit court. If the decision is upheld there, it would then also apply to New Hampshire couples. From there it would go to SCOTUS, which obviously would apply to the whole country. If it gets to SCOTUS, Justice Kennedy would likely be the swing vote. I don't want to get too optimistic, but I could see him giving us the 5-4 win. It couldn't even pass 'rational basis', afterall...But that would be a long, long ways in the future anyways...
Actually, it means a lot. You know how many court cases have been won in the supreme court because of just one being won in a district court? A lot. And I mean a lot.
CNN was talking about it a few seconds ago and they said this could reach the Supreme Court. If they allow it, gay marriage could be a constitutional right in all states.
Even the possibility sends chills down my spine! (In a good way) <3 Although, it's probably too good to be true.
Please let this go through :/ Im hoping that by the time I want to marry someone it would be legal everywhere in the US..... hopefully...... or at least in NY
